4M2, Services and Production Craft, through the website www.neksi.eu, provides a service for ordering and purchasing the craft's products.
This document, along with the documents referenced herein, establishes the general terms and conditions that govern the use of this website and the purchase of products through it. Please read these Terms and Conditions and our Privacy Policy carefully before using this website.
By using this website or placing an order through it, you are agreeing to be bound by these Terms and our Privacy Policy. If you are a minor, please refrain from using this site. If you do not agree with these Terms and the Privacy Policy, please do not use this website to purchase products or obtain related information.
You are responsible for reviewing the Terms and Conditions periodically, as the version in effect at the time of website use or order placement is the one that will apply.

OUR RIGHT TO MODIFY TERMS
The manufacturer is authorized and entitled, without prior notice, to change the content of these Terms and Conditions, the product assortment, prices, and other information related to the webshop, as well as any other content on the website www.neksi.eu.
For this reason, users are required to review the website content during each visit.
Failure to do so releases the manufacturer from any liability.
The website reserves the right to errors in product descriptions and images.
PRIVACY GUARANTEE
4M2, Services and Production Trade, is committed to safeguarding the privacy and confidentiality of all personal data of our visitors and customers, under the Electronic Commerce Act (Official Gazette Nos. 173/2003, 67/2008, 36/2009, 130/2011, 30/2014) and the General Data Protection Regulation (GDPR).
All employees of the business and its contractual partners are legally bound to uphold the principles of privacy and data confidentiality.
We collect only the essential, basic information about our customers/users and inform them about how their data will be used.
Customers are regularly offered the option to choose whether or not their data will be used for purposes such as marketing communications, including the option to request removal from marketing mailing lists.
Customers' data is stored in the business’s IT system, kept in a secure location, and accessible only to employees and contractual partners who require it to provide quality service.
Use of the data is limited to communication with customers for the purpose of fulfilling orders, completing sales transactions, and informing users about news and offers available on our website.
The business guarantees that users' data will not be shared or disclosed to third parties without their explicit prior consent.
This guarantee does not apply to lawful requests from authorised Croatian government authorities for regulatory or business compliance inspections.
TERMS AND CONDITIONS
CONCLUSION OF A SALES CONTRACT
Predmet i komercijalna svrha Ugovora je narudžba i kupnja odabranog proizvoda putem interneta. Ugovor se zaključuje sredstvima daljinske komunikacije (Ugovor sklopljen na daljinu) putem interneta.
Ovi Uvjeti, kao i pojedini uvjeti narudžbe naznačeni uz informacije o određenim proizvodima predstavljaju ponudu obrta za sklapanje ugovora. Korisnik kao kupac svojom registracijom, zaključivanjem narudžbe i plaćanjem
prihvaća uvjete, čime se smatra da je zaključen ugovor između kupca i obrta prema uvjetima prodaje
navedenim ovim Uvjetima.
UNILATERAL TERMINATION OF THE CONTRACT
In accordance with the Consumer Protection Act, the buyer may unilaterally terminate the contract within 14 (fourteen) days without providing any reason.
The period for unilateral termination begins on the day the buyer takes possession of the goods subject to the contract. You may terminate the contract by using the form provided below. A standard information form for unilateral termination of the contract can be downloaded here.

We will confirm receipt of your notice of contract termination without delay via email. In the event of termination, each party is required to return to the other what was received under the contract, under the provisions of the Consumer Protection Act.
We will process the refund once the returned goods have been received. You must return the goods without delay and no later than 14 days from the day you notified us of the unilateral termination.
The buyer is required to return the goods to the following address:

The goods must be returned via the same method they were originally delivered. It is recommended that the buyer obtain proof of shipment when returning the goods.
If the buyer requested that service delivery begin during the withdrawal period, they must pay the seller an amount proportional to what has been delivered up to the moment the seller was notified of the termination.
The buyer bears the direct costs of returning the goods.
We do not accept parcels sent with cash-on-delivery (COD).
Refunds will be issued using the same method used for the original payment. A refund will only be processed after the returned goods have been received.
The buyer is responsible for any reduction in the value of the goods resulting from handling beyond what is necessary to determine the nature, characteristics, and functionality of the goods.
If the buyer returns a product without its original packaging and/or with damage and/or visible signs of use, and the product is no longer in sellable condition, the seller is not obligated to issue a refund, even if the buyer invokes the right of unilateral termination of a distance contract.
PRICES OF PRODUCTS AND AVAILABILITY OF OUR SERVICES
Product prices are listed in euros and include delivery costs.
The delivery service for products offered on this website is available within the Republic of Croatia. Product prices are subject to change until the purchase is confirmed. Each product is priced individually. Prices may change at any time; however, such changes will not affect orders for which we have already sent an order confirmation.
Once you have selected all the products you wish to order and purchase, they will be added to your shopping cart.
The next step is to process the order and make the payment.
To do this, you need to follow the steps of the checkout process and provide or confirm the required information at each stage.
Additionally, during the checkout process and before payment, you will have the opportunity to modify your order details.
PAYMENT METHOD AND PROCEDURE
Payment for products can be made securely via online card payment (Stripe) on the website www.neksi.eu.
After confirming your order, you will be prompted to complete the payment through the website. All required information must be entered accurately.
Your order will be processed for delivery within 24 to 72 hours after the order has been submitted and the payment has been successfully completed.
The buyer does not bear any transaction fees, such as bank or financial service charges (e.g., FINA).
The sales contract is deemed concluded at the moment the payment is received into the business’s account.
Please note that a contract on behalf of a minor or a person without legal capacity may only be concluded by a legal guardian. A person with limited legal capacity may enter into a contract only with the consent of their legal guardian.
DELIVERY AND DELIVERY TERMS
Delivery is free of charge within the Republic of Croatia, including both the mainland and the islands.
The delivery time for products throughout Croatia is up to 7 working days from the date the order is placed.
If there is any change to the delivery time or any other important factor affecting the fulfilment of your order, our customer service team will notify you immediately.
Delivery services are provided by Hrvatska Pošta d.d. and DPD within the territory of the Republic of Croatia.
INTELLECTUAL PROPERTY RIGHTS
The website www.neksi.eu contains materials protected by copyright, trademarks, design rights, and other rights held by individuals or legal entities. This includes, but is not limited to, rights related to text, applications, photographs, video materials, graphics, music, sound, and similar content, unless otherwise stated.
It is not permitted to alter, publish, transmit, reproduce, participate in the transfer or sale, create derivative works, or in any way exploit any part of the content, in whole or in part, without the explicit written permission of the rights holder.
You are not authorized to download, reproduce, modify, edit, distribute, display, delete, transmit, sell, resell, adapt, or otherwise alter any copyrighted materials in any way, except for personal use only.
For the avoidance of doubt, NEK' SI explicitly retains all rights and does not transfer any rights to the user in relation to the content of the webshop and website. Use of the webshop and website content is strictly limited to what is defined in these Terms and Conditions or explicitly permitted by instructions on the website.
NEMOGUĆNOST DOSTAVE
If delivery cannot be completed within 15 days from the date of payment due to reasons beyond our control, we will assume that you wish to terminate the contract and will proceed to cancel it.
We reserve the right to charge you for any additional transportation costs incurred as a result of the contract termination.
TRANSFER OF RISK AND PRODUCT OWNERSHIP
The buyer assumes responsibility for the products from the moment of delivery.
COMPLAINTS AND OBJECTIONS
Ordered products are packaged to prevent damage during transport/delivery.
The buyer is obligated to inspect the packaging upon receipt.
If the package shows visible damage or defects, we recommend that the buyer decide whether or not to accept the delivery.
If the buyer believes the goods are damaged, we recommend refusing the package.
If refused, the delivery service will return the package to the business, noting that it contains visible defects.
In accordance with the Obligations Act (NN 35/05, 41/08, 125/11, 78/15, 29/18, 126/21, 114/22, 156/22, 155/23) and the Consumer Protection Act (NN 19/22 and 59/23), any complaints regarding product defects or other grievances may be submitted in writing, either via email or regular mail:

The business commits to providing a written response within 15 days of receiving the complaint, clearly stating whether the claim is accepted.
Please include your full name and address so we can respond appropriately.
In the case of a justified complaint, the customer is entitled to a contract cancellation with a refund or a product replacement.
If the complaint is justified and the buyer did not cause the defect, damage, or issue with the product, the business will cover the return shipping costs.
In the case of a valid complaint, all costs of replacing the product with a new one will be borne by the business.
Products that have been tampered with, repaired, or altered by the consumer, or have been damaged through improper use, cannot be claimed under warranty or returned.
In case of a dispute regarding the validity of the complaint and the condition of the returned product, the product must be unused, in its original quantity, and in original packaging, accompanied by the original receipt and warranty, if applicable.
In the event of a dispute between the business and the buyer, the buyer may seek out-of-court dispute resolution in accordance with the Consumer Protection Act.
NOTICE ON THE METHOD OF SUBMITTING A WRITTEN CONSUMER COMPLAINT
In accordance with Article 10 of the Consumer Protection Act (NN 19/22 and 59/23), we inform our customers that any dissatisfaction with the provided product or service can be submitted through one of the following methods:

The business is obligated to promptly confirm receipt of the consumer complaint in writing.
We also undertake to respond in writing within 15 days of receiving the complaint, clearly stating whether the complaint is accepted, in accordance with this Notice.
To help us respond properly, please include your full name, surname, and address in any complaint submitted in person or by post.
In accordance with Regulation (EU) No 524/2013 of the European Parliament and Council, traders engaged in online contracts must provide an electronic link to the Online Dispute Resolution (ODR) platform.

PRODUCT REPLACEMENT
All customers have the right to exchange a product.
A product exchange is possible within 14 working days from the date of receipt of the shipment.
The customer must request the exchange via email to info@neksi.eu within the 14 working day period.
In the request, please specify whether you wish to exchange the product for the same item in a different size or color, or for a different product from our selection.
After we confirm the availability or production feasibility of the requested replacement item, we will approve the request and notify the customer.
The original product must then be returned to the following address within 7 working days from the approval date:

Once we verify that the returned product is unused, in its original quantity, and in its original packaging, and upon presentation of the original receipt, the exchange will be processed.
All costs related to the exchange, including return shipping and resending of the new product, are borne by the customer.
If the replacement product is of higher value, the customer must pay the difference in advance.
If the new product is of lower value, the difference will be refunded to the customer’s IBAN account.
When returning a product for exchange, the package should be sent using the same delivery method as originally received.
We recommend that the customer obtain proof of shipment when returning the product.
